CMS Extending Use of “Expired” ABN Form
Recently, CMS noted that the current Advance Beneficiary Notice of Noncoverage (ABN) form, which was slated to “expire” and be superseded by a new version at the end of March 2020, is acceptable for use temporarily. You may notice that your current ABN forms have “03/2020” at the bottom as the version number. Use of an “expired” ABN form version could render it invalid and you could be forced to return the funds collected from a beneficiary. CMS has made it possible to use the current form until the new one is approved.
CMS noted on their Fee-for-Service (FFS) ABN webpage the following short notice (CMS added the boldface emphasis and ***):
***The ABN, Form CMS-R-131, is currently awaiting OMB approval for renewal. CMS will provide instructions when it does get approved. In the meantime, continue to use the current form until further instruction is provided.
